Implementation of the Security of Payment Provisions in Public Works Contracts
On 5 October 2021, the Government promulgated DEVB TCW No. 6/2021 setting out the policy on the implementation of Security of Payment (SOP) Provisions progressively in public works contracts with a view to facilitating timely processing of contract payments and providing for resolution of payment disputes through adjudication. The Technical Circular will be implemented in applicable tenders to be invited on or after 31 December 2021.
The Institution has been admitted to the Register of Adjudicator Nominating Bodies to perform the functions and obligations of an adjudicator nominating body (ANB) for the purpose of implementing SOP Provisions in public works contracts, and the registration is valid from 1 January 2022 to 31 December 2024.
